RE-MORTGAGE

Our fee for a re-mortgage is £395.00 plus VAT plus the Land Registry document fees.  Our Telegraphic Transfer fees and Our Electronic Identity Search fees are as set out above.  As regards search fees we will not be able to give you an estimate for the search fees without knowing who the mortgage lender will be as often search indemnity insurance may be available at a lower cost and may help to speed the transaction up.  The Land Registry fee payable will be between £20.00 - £80.00 up to a re-mortgage value of £500,000.00.

PLEASE NOTE all the above figures for our legal fees are only an estimate for a transaction that proceeds in the normal way with no unforeseen matters arising including, for example (but not limited to), a defect in title to the property which requires remedying.  The estimate for our fees does not include the preparation of additional documents linked to the main transaction, for example, negotiating a new Lease, preparing a Declaration of Trust or dealing with indemnity policies that are required to remedy a defect.  For confirmation of the amount that we will charge, please contact us direct as there are many aspects which are taken into account when detailing our fees.  This is especially the case with low value transactions that may prove to be complicated.  The above fees and disbursements do not cover Transfer of Equity which is often applicable where home owners are separating or divorcing.

In the case of a leasehold sale or purchase, there will be an additional fee of £150.00 plus VAT to deal with the leasehold aspects of the transaction.  The fee of £150.00 plus VAT does not include any payment to the landlord or management company to obtain information relating to ground rent, insurance, service charge etc. nor any adjustments due to a shortfall or overpayment of ground rent and service charge up to the date of completion. 

In the case of a leasehold purchase, there will be other payments due to the landlord or management company in order to register your purchase with them.  The fees payable vary and usually are from £50.00 - £200.00 plus VAT but this is only an estimate and precise figures will be available from the seller’s solicitors at a later date.

In relation to search fees on a purchase, the precise figure will depend upon the type of searches made which normally include local authority, water and drainage, environmental and chancel repair (where applicable).

In relation to Land Registry registration fees, if the property is not yet registered at the Land Registry (we will not know this until we receive a draft Contract) the fee will be double.  There may be additional fees to register the property in your name at the Land Registry for the first time especially if problems are anticipated with further evidence being required from the Land Registry.

Stamp Duty Land Tax on your purchase depends on the purchase price of the property and whether a higher rate is payable.  You can calculate the amount you will need to pay by using the calculation on HMRC’s website or, if the property is located in Wales, by using the Welsh Revenue Authority’s website.  If your purchase is a Buy to Let or, if you already own and live in a property that you are not selling, you will need to speak to us to ascertain whether a higher rate of Stamp Duty Land Tax is payable.  This is a complex area.

In relation to Land Registry registration fees on a re-mortgage, our fee and the Land Registry fee does not cover re-mortgaging of part of a registered property.
