At the heart of the matter
Divorce and separation can be emotionally overwhelming, especially when children are involved. All parents wish to shield their children from the impact of divorce and separation, and our team works with a deep understanding of this protective desire. Our advice is sensitive, pragmatic and sensible, enabling you to achieve solutions that are practical, workable and child-focused.
Our experienced family law team understands the importance of protecting the well-being of your children during this challenging time. We’re with you in believing that the best interests of your children come first. Our expert guidance and support provides everything you need to ensure the best possible outcome for your family.
How we help
We can advise on all issues involving children, including applications for Parental Responsibility Orders, Specific Issue Orders, Prohibited Steps Orders and Child Arrangement Orders. We recognise that the end of a relationship can have a significant impact on the wider family, and we can also act for grandparents wishing to spend time with their grandchildren.
Our experience includes advising on:
- Where the children live and the time they spend with each parent
- Relocation within England and Wales or another country
- Child abduction
- Issues in relation to education
- Proposed medical treatment
- Issues surrounding religious upbringing
- Parental Responsibility
We always aim to resolve these issues through negotiation. Should it be necessary to start Court proceedings, including making emergency applications to protect your children, we are standing by to help.
Special Guardianship
A Special Guardianship Order is an order appointing one or more individuals to be a child's 'special guardian.' It is a private law order made under the Children Act 1989 and is intended to allow children who cannot live with their birth parents to benefit from a legally secure placement.
Special Guardianship Orders are more secure than a Child Arrangements Order, because a parent cannot apply to discharge it unless they have the permission of the Court to do so. However, it is less secure than an Adoption Order, because it does not end the legal relationship between the child and their birth parents.
At Blanchards Bailey, we specialise in this area of family law and possess the expertise to navigate the complexities of the process. Our team is committed to helping you understand your rights and responsibilities as a special guardian, providing compassionate guidance every step of the way.
